Terms of Service

Welcome to Bullstart (we, us, our, or the Application Developer). Bullstart is a print-on-demand fulfillment service based in Oceanside, California, United States. We provide custom printing, warehousing, and order fulfillment services to e-commerce sellers, including sellers on platforms such as TikTok Shop, Etsy, Shopify, and other marketplaces.

By accessing or using our services, you agree to these Terms of Service. If you do not agree, please do not use our services.

1. Services

Bullstart provides the following services to e-commerce sellers:

  • Print-on-demand production using DTF (Direct to Film) technology
  • Product fulfillment and order management
  • Warehousing and inventory management
  • Shipping via USPS and other carriers
  • Integration with marketplace platforms (TikTok Shop, Etsy, Shopify, etc.)
  • Design management and product catalog tools

2. Account Registration

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

3. Marketplace Integrations

Our application integrates with third-party marketplace platforms, including Etsy, TikTok Shop, and others. When you connect your marketplace account:

  • We access your marketplace data only through official APIs and OAuth authentication
  • We do not use screen-scraping or any unauthorized methods to access marketplace data
  • We process your data only to fulfill the services described in these Terms
  • You grant us permission to access and use your marketplace data as necessary to provide our services
  • You may disconnect your marketplace account at any time through the application settings

4. Etsy Integration

Our application uses the Etsy API to provide integration services for Etsy sellers. By connecting your Etsy account, you acknowledge and agree:

  • We access your Etsy shop data through OAuth 2.0 authentication with PKCE
  • Data accessed through the Etsy API is cached in accordance with Etsy caching policies
  • We do not access buyer email addresses without separate approval from Etsy
  • You are responsible for complying with Etsy Terms of Use when using our services

5. Warranty Disclaimer

DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY BULLSTART (THE APPLICATION DEVELOPER). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

Our services are provided on an as-is and as-available basis without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.

6. User Responsibilities

You agree to:

  • Use our services only for lawful purposes
  • Not infringe upon any third party intellectual property rights
  • Ensure that all designs and content you upload comply with applicable laws
  • Not use our services to produce or distribute prohibited, counterfeit, or illegal products
  • Comply with all applicable marketplace terms and policies

7. Payment and Fees

You, and not any third-party marketplace, are responsible for all fees associated with the use of our services. Bullstart is the sole entity responsible for invoicing and collecting fees. Pricing is available through your account dashboard and may be updated from time to time.

8. Intellectual Property

You retain ownership of all designs and content you upload to our platform. By uploading content, you grant us a limited license to use, reproduce, and process your content solely for the purpose of fulfilling your orders. We do not claim ownership of your content.

9. Data Privacy

Your privacy is important to us. Our collection, use, and sharing of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

With respect to marketplace data accessed through APIs:

  • We process data only to fulfill the services described in these Terms
  • We store OAuth tokens securely
  • We comply with applicable privacy laws, including CCPA/CPRA where relevant
  • In the event of a data breach involving marketplace data, we will notify the affected platform and users as required by applicable law

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bullstart and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our services.

11. Indemnification

You agree to indemnify and hold harmless Bullstart, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our sole discretion. Upon termination:

  • Your right to use our services will immediately cease
  • We will disconnect marketplace integrations where applicable
  • Any outstanding fees will become immediately due
  • We may delete stored marketplace tokens according to our retention practices

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through our platform. Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

15. Third-Party Trademarks

The term 'Etsy' is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

TikTok and TikTok Shop are trademarks of ByteDance Ltd. This application is not affiliated with or endorsed by TikTok or ByteDance.

All other trademarks, service marks, and trade names referenced in this application are the property of their respective owners.
